These Terms and Conditions are for the supply of goods from us, that’s hayesproducts.com which is the trading name of Hayes Fabrications Ltd of Unit 2, Marchington Industrial Estate, Stubby Lane, Marchington, Uttoxeter, Staffordshire ST14 8LP England.
All orders are supplied subject to these terms and conditions and are subject to acceptance by us. It is when we accept the order and schedule a delivery of the goods that we enter into a legally binding contract between us. The processing of your payment and acknowledgement of your order does not constitute legal acceptance of your order. If we are unable to process your order we will refund to the same means as the original payment.
The prices shown on the website are the prices that you will pay, occasionally we may make an error and incorrectly price goods, in these circumstances we will be under no obligation to supply at the incorrect price.
We only despatch to you upon receipt of payment. Title of the goods does not pass until payment is received in full. If however a payment is revoked subsequently by the bank we will remain the legal owners of all of the goods supplied. In which case you should hold the goods on our behalf as bailee on a fiduciary basis at your own cost separately and clearly marking them in a way that they can be recognised as our property.
Many Hayes Products are manufactured specifically for you upon receipt of your order, please allow around 10 working days from order and payment unless otherwise agreed. We will attempt to despatch goods to the specified address or site shown on your order, however we may only be able to deliver to the address shown on your payment card.
We are manufacturers and manufacturer each Hayes branded item upon receipt of your order. In order to provide a better service for our client, some items are sourced from other manufacturers and are considered standard stock items. For these items we try our best to hold sufficient stock for expected sales if however the item is out of stock we will endeavour to contact you as soon as possible to advise of the delay giving you the option to wait or cancel the order.
We are a UK based company and the goods that we supply are confirmed as being suitable for use in the UK and comply within the UK law. Although many products will be suitable for applications in order countries in particular within Europe you must make your own enquiries as to suitability. All goods are supplied in accordance within the manufacturers specifications and are subject to any qualifications, representations or instructions contained within the product.
If you have any problems with any of the goods that we supply, whether it is a shortage, non-delivery or if goods are damaged or defective upon delivery, let us know as soon as possible but certainly within 7 days and we will make good or refund the goods in question as appropriate.
Our liability will be limited to the amount of money that you have paid for the goods but we will not be liable for any other compensation such as loss of business, loss of profits or any costs relating to the goods. We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered here under that is caused by any event or circumstance beyond our reasonable control.
Each Hayes product is made at our Staffordshire factory in accordance with your specific instructions. Standard products only may be eligible for a refund, bespoke items cannot be accepted for refund. Please ensure when making your purchase that your instructions are correct.
Return items without fault carry a 20% restocking charge. Returns not accepted without an RMA code.
Any item that we have (1.)manufactured to your specified sizes or colour (2.) adjusted or modified standard product in any way.
This does not affect your statutory rights if you are a consumer nor is it intended to excludes our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.
If any part of these conditions is invalid illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract and sales shall be governed by and interpreted in accordance with English law.
